Terms of Use
These Terms of Use (“Terms”) govern your use of the gomando iOS application (“App”) offered by the developer identified on the App Store. By downloading or using the App, you agree to these Terms.
1. The App
gomando provides tools to discover and control compatible televisions on your local network. Features, supported brands, and protocols may change with updates. We do not guarantee compatibility with every TV or firmware version.
2. Eligibility & Apple terms
You must comply with Apple’s Licensed Application End User License Agreement (EULA) where applicable, in addition to these Terms. If you are using the App on an Apple device, Apple is not responsible for the App or its content except as required by Apple’s EULA.
3. Acceptable use
You agree to use the App only on networks and devices you are authorised to use, and in compliance with law. You will not use the App to harass others, violate intellectual property, reverse engineer the App beyond what the law allows, or attempt to disrupt networks or devices.
4. Subscriptions & purchases
If the App offers paid features or subscriptions:
- Purchases are processed by Apple through In-App Purchase.
- Payment, renewal, cancellation, and refunds are subject to Apple’s terms and the subscription terms shown at purchase time.
- We may change pricing or features with reasonable notice where required.
5. Intellectual property
The App, its design, text, graphics, and branding are owned by us or our licensors. We grant you a personal, non-exclusive, non-transferable licence to use the App as permitted by the App Store rules and these Terms. You may not copy, modify, distribute, or create derivative works of the App except as allowed by law.
6. Disclaimer of warranties
The App is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation or that every TV will pair or respond correctly.
7. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the App. Our total liability for claims arising from the App is limited to the greater of (a) the amount you paid us for the App or subscriptions in the twelve months before the claim or (b) fifty euros (€50), unless mandatory law requires otherwise.
8. Indemnity
You agree to indemnify and hold harmless the developer from claims arising from your misuse of the App or violation of these Terms, to the extent permitted by law.
9. Changes & termination
We may modify the App or these Terms. Material changes will be reflected by updating the “Last updated” date and, where appropriate, in-app notice. We may suspend or discontinue the App. You may stop using the App at any time by uninstalling it.
10. Governing law
Unless mandatory consumer protection rules in your country require otherwise, these Terms are governed by the laws of the jurisdiction in which the developer is established, without regard to conflict-of-law rules. Courts in that jurisdiction may have exclusive jurisdiction, subject to non-waivable rights you may have as a consumer.
